Workmanship Warranty

Contractor hereby provides a TWO-year workmanship warranty for shingle roofs and a FIVE-year workmanship warranty for tile and metal roofs beginning on the date of the Final Inspection. The Contractor will assign and provide any roof material manufacturer’s warranty upon completion of the work. If a problem occurs during the warranty period, Owner must promptly notify Contractor. In the event that the problem is due to workmanship, Contractor will repair or replace the portion of roof at issue at no charge to Owner. Owner may purchase an extended warranty if desired. Contractor’s workmanship warranty is transferable one time. For any warranty to be valid, this Contractor must be paid in full for the work performed. CONTRACTOR MAKES NO EXPRESS OR IMPLIED WARRANTIES, EXCEPT AS STATED HEREIN. ALL STATED WARRANTIES ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED. THERE ARE NO IMPLIED WARRANTIES OF FITNESS OR MERCHANTABILITY.

Definition of Workmanship

This warranty is expressly limited to issues caused by workmanship. “Workmanship” refers to the proper installation techniques and practices employed by the Contractor and its employees in accordance with industry standards, manufacturer’s guidelines, and applicable building codes at the time of installation. This warranty covers defects in installation that result in leaks, improper drainage, or other failures of the roofing system as directly attributable to the installation process.

Exceptions to Workmanship Warranty

The following situations and conditions are exceptions to the workmanship warranty and are not covered under this warranty:

• Damage resulting from natural disasters or acts of God, including but not limited to tornadoes, tropical cyclones (i.e., tropical storms, hurricanes), high wind events, hail, earthquakes, floods, and lightning strikes.
• Damage caused by other contractors, trades, or workers performing work on or around the finished roof after the completion of the Contractor’s work.
• Damage resulting from improper maintenance or neglect by the Owner, including failure to keep the roof clear of debris or failure to address known issues in a timely manner.
• Damage resulting from structural movement or settling of the building or foundations.
• Damage resulting from defects in the underlying structure on which the roof is installed such as warped sheathing boards.
• Damage caused by the installation or repair of rooftop equipment, antennas, satellite dishes, or any other additions or modifications to the roofing system performed by parties other than the Contractor.
• Damage caused by animals, pests, or insects.

Warranty Voidance

The workmanship warranty will be voided under the following conditions:

• If the roof is subjected to an act of God as described in the exceptions section.
• If other contractors or workers perform work on the finished roof without prior written consent from the Contractor.
• If the Owner fails to maintain the roof as recommended by the Contractor, including periodic inspections and cleaning.
• If the Owner fails to promptly notify the Contractor of any issues or defects in the roofing system.

Additional Disclaimers

• This warranty does not cover any consequential or incidental damages, including but not limited to damage to the interior of the building, mold, personal property, or loss of use.
• The Contractor’s liability under this warranty is limited to the repair or replacement of the defective portion of the roofing system, at the Contractor’s discretion.
• This warranty does not cover any repairs or replacements made necessary by misuse, abuse, or negligence by the Owner or any third party.
• The Contractor shall not be liable for any delays in performing warranty repairs due to factors beyond its control, including weather conditions, material shortages, or other unforeseen circumstances.
